Man granted bail in Garuga estate land fraud case

A court has released a 65-year-old man on bail as he faces charges related to the alleged fraudulent transfer of land belonging to the late businessman Dr James Musinguzi Garuga.

Buganda Magistrates Court has granted Charles Byaruhanga cash bail of Shs3 million after he was accused of fraudulent dealings involving companies and property linked to Dr Garuga's estate. Chief Magistrate Ritah Neumbe Kidasa set conditions requiring Byaruhanga to lodge the title deed for his land in Masajja, Wakiso District, and hand over his passport. His sureties were each bonded at Shs50 million.

The case centres on the alleged transfer of approximately 849 hectares, or about 2,097 acres, of land at Bulemezi Ngoma in Nakaseke District. The property is registered under the name of Incafex Limited, a company connected to Garuga's business interests. Prosecutors allege the transfer occurred without a valid board resolution and in breach of a Supreme Court injunction.

The prosecution claims company records were altered through filings and false resolutions, and that co-accused Agaba Magulu Male was improperly entered as a director while records falsely listed deceased individuals including Dr Garuga as directors. The Uganda Registration Services Bureau ordered the removal of filings that had appointed Magulu as a director of several Garuga-linked companies in July 2026.

The dispute arose after Garuga died on August 6, 2025. Criminal summons have been issued for Byaruhanga's co-accused Magulu and Henry Hapa Nganwa. The allegations remain to be proved in court.
