The Parklands Residents Association has declared property development approvals issued in Nairobi's Parklands area after October 14, 2026, to be null and void. The association cited Nairobi City County's failure to comply with a court judgment handed down on October 14, 2025.
The Environment and Land Court ordered the county to establish a physical planning consultative forum within six months and prepare and gazette development plans for Nairobi County and Parklands within 12 months. According to a notice dated October 15, 2026, both deadlines passed without the forum being set up or the plans being published.
The court found that the county had not established the consultative forum required under the Physical and Land Use Planning Act, 2019. It also ruled that the county's actions and failures relating to Parklands developments since August 2019 had breached residents' constitutional rights to human dignity and to a clean and healthy environment.
The voided approvals include changes of use, increased development density, lease extensions and renewals, property subdivisions and amalgamations, demolitions, building works and certificates of occupation.
