A High Court case against Optiven Limited has ended after the company and plaintiff Peter Mulati Nabiswa reached a settlement agreement. The Kenya Gazette published notice of the withdrawal. The case, filed at the High Court in Kiambu, had been authorised to proceed as a representative action, allowing Nabiswa to pursue the lawsuit on behalf of other affected people. The court approved the representative proceedings on August 4, 2026, and ordered that notices be published in major newspapers and the Kenya Gazette.
The parties agreed to settle on August 28, and the High Court formally adopted the consent agreement on September 21, ending the representative proceedings. The case had involved questions about land use, with court records indicating that the land in question had been reserved for public use since 1969 by the then Nairobi City Council.
